PMWJ H.B. 787 75(R)BILL ANALYSIS JUDICIAL AFFAIRS H.B. 787 By: Gallego 4-2-97 Committee Report (Unamended) BACKGROUND Fees are collected by the fourteen courts of appeals from parties for the filing of cases and deposited as unappropriated revenue equally in Fund 540 (50%) and Fund 573 (50%). The fees have not been increased since 1983. PURPOSE H.B. 787 would increase the filing fees charged by courts of appeals. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1 amends Section 51.207(b), Government Code, to raise certain fees charged by courts of appeals, as follows: (1) Cases appealed to and filed in a court of appeals - from $50 to $100, (2) To file motion for leave to file petition for writ of mandamus, writ of prohibition, injunction or similar original proceeding - from $20 to $50, (3) Additional fee if original motion is granted - from $30 to $75, and (4) Motion to file or extend time to file record on appeal - from $5 to $10.
