DIGEST 

Currently, certain hospitals, the federal government, the State 
of Texas and other hospital district are 
authorized to contract or cooperate with the board of hospital 
managers of the hospital district. 
Hospitals that are located outside the hospital's district 
boundary are excluded from this authority. 
This bill provides more flexibility in contracting between 
hospital districts.   

PURPOSE

As proposed, H.B. 794 provides more flexibility in contracting 
between hospital districts.

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a 
state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 281.050, Health and Safety Code, to 
require the approval of the 
commissioners court to be required for the sale or lease of a 
hospital facility regardless of the 
provisions of Section 285.051, Health and Safety Code.

SECTION 2. Amends Section 281.051, Health and Safety Code, to 
authorize the board of hospital 
managers of a hospital district (board) to contract or cooperate 
with another governmental entity, 
rather than a municipality, under certain conditions.  Deletes 
another hospital district and a privately 
owned hospital located in the district from the provision 
authorizing the board to contract or 
cooperate with these entities.  Deletes Subsection (b) which 
requires the commissioners court and 
the board to determine that a contract under Subsection (a) 
contains certain characteristics. 
Redesignates existing Subsection (c) as new Subsection (b).  
Makes a conforming change.

SECTION 3. Effective date:  September 1, 1997.

SECTION 4. Emergency clause.
