PUC C.S.H.B. 827 75(R) BILL ANALYSIS STATE RECREATIONAL RESOURCES C.S.H.B. 827 By: Turner, Bob 4-24-97 Committee Report (Substituted) BACKGROUND Under current statute, the Texas Parks and Wildlife Commission has the authority to set a lower fee or waive a fee for a hunting or fishing license for a qualified disabled veteran, if they so choose. PURPOSE As proposed, CSHB 827 will require the commission to waive hunting or fishing license fees for qualified disabled veterans. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends Section 42.012 (b), Parks and Wildlife Code, by striking the language pertaining to qualified disabled veterans in the section which describes the Commission's discretion in waiving or lowering hunting and fishing license fees and adding a sentence which requires the commission to waive the fee. SECTION 2: Amends Section 46.004, Parks and Wildlife Code, by deleting language in (b) (3) relating to qualified disabled veterans and adding a new subsection (c), to requires the Parks and Wildlife Commission to waive the fee for a qualified disabled veteran. SECTION 3: Effective date: September 1, 1997. SECTION 4: Emergency Clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The caption in the committee substitute is amended to delete the reference to certain military personnel. CSHB 827 deletes SECTION 1 from the original bill and renumbers the following sections appropriately.
