AEZ H.B. 919 75(R)BILL ANALYSIS CRIMINAL JURISPRUDENCE H.B. 919 By: Jones 4-17-97 Committee Report (Unamended) BACKGROUND Section 46.06(a)(2), of the Penal Code, Unlawful Transfer of Certain Weapons, prohibits the selling lending, renting or giving a firearm to a child younger that eighteen years of age. The offense for violating this law is a Class A misdemeanor. PURPOSE HB 919, as proposed, would increase the offense unlawful transfer of certain weapons from a class A misdemeanor to a state jail felony. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1:Amends Section 46.06(d) of the Penal Code to read that an offense committed under Subsection (a)(2) is a state jail felony. SECTION 2:This Act only applies to an offense committed on or after the effective date of this Act. Any offense committed before the effective date of this Act is covered by the law in effect when the offense was committed. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause.
