JLM C.S.H.B. 939 75(R) BILL ANALYSIS PUBLIC EDUCATION C.S.H.B. 939 By: Flores 5-2-97 Committee Report (Substituted) BACKGROUND Currently, school districts are not required to pay employees at the normal rate of pay for time spent replying to a jury summons, or valid subpoena. PURPOSE As proposed C.S.H.B. 939, prohibits a school district from penalizing an employee for compliance with a jury summons. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1 Amends Chapter 22, Education Code, by adding Section 22.006 to read as follows. Section 22.006. DISCRIMINATION BASED ON JURY SERVICE PROHIBITED. (a) states a school district may not penalize an employee in any way for complying with jury duty. (b) stipulates how employees will be compensated after missing work to serve on juries. (c) says employees personal leave may not be reduced because of jury duty. SECTION 2 Effective Date. SECTION 3 Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE CSHB 939 more clearly stipulates that a school district may not discriminate an employee for jury service. Additionally, CSHB 939 details how an employee will be financially compensated after serving on a jury depending on whether they are a salaried employee or not.
