SRC-MAX H.B. 979 75(R) BILL ANALYSIS Senate Research Center H.B. 979 By: Junell (Barrientos) State Affairs 5-8-97 Engrossed DIGEST Currently, the Transportation Code limits an airport or air navigation facility lease, contract, or other arrangement, between a local government and any other party, to a 40-year term. This bill provides exceptions to this limitation for an airport or air navigation facility lease, contract, or other agreement between certain entities. PURPOSE As proposed, H.B. 979 sets forth provisions regarding the duration of certain agreements between a local government and this state or the United States in connection with the airport or air navigation facility. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22.021, Transportation Code, by adding Subsection (d), to provide that the 40-year limit on the term of a contract, lease, or other arrangement provided by Subsection (a) does not apply to a contract, lease, or other arrangement under this section between a local government and this state, the United States, or an agency or instrumentality of this state and the United States. SECTION 2. Emergency clause. Effective date: upon passage.
