In 1989, the 71st Legislature provided that the records of abolished local governments would be transferred to the custody of the Texas State Library and Archives Commission. This bill transfers the custody of records of abolished local governments from the Texas State Library and Archives to the General Services Commission. PURPOSE As proposed, H.B. 996 transfers the custody of records of abolished local governments from the Texas State Library and Archives to the General Services Commission. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 201.007(b), (c), (f), and (g), Local Government Code, to require an abolished municipality's governing body to transfer the records of the municipality to the custody of the General Services Commission (commission), rather than the Texas State Library and Archives Commission (TSLAC). Requires the cost of transferring the commission to be paid out of the funds of the abolished local government, rather than TSLAC. Requires the cost of the transfer to be paid out of the funds of the commission, if funds of the local government are not available for this purpose. Requires the records retention schedules issued by the commission to be used, as far as practicable, as the basis for the retention and disposition of records transferred to the commission. Deletes a provision requiring the retention and disposition of transferred records to be based, as far as is practicable, on records retention schedules issued by TSLAC. Makes conforming and nonsubstantive changes. SECTION 2. Requires the Texas State Library and Archives Commission to transfer to the General Services Commission as soon as practicable after September 1, 1997, the records of an abolished local government. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause.
