SCT H.B. 996 75(R)BILL ANALYSIS STATE FEDERAL & INTERNATIONAL RELATIONS H.B. 996 By: Hunter 4-7-97 Committee Report (Unamended) BILL ANALYSIS BACKGROUND In enacting the Local Government Records Act of 1989, the 71st Legislature provided that the records of abolished local governments would be transferred to the custody of the Texas State Library and Archives Commission. The General Services Commission is charged by law with taking custody of the records of abolished state agencies. All records of all abolished governmental entities should be kept by the same agency. Therefore, the custody of the records of abolished local governments should pass to General Services Commission. PURPOSE This legislation transfers the custody of records of abolished local governments from the Texas State Library & Archives to the General Services Commission. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Changes Section 201.007(b), (c), (f), and (g), Local Government Code, so that records of abolished local governmental entities will be given from the government to the GSC, instead of the TSL&A. SECTION 2. Sets the time in which the TSL&A will transfer their records to the GSC. SECTION 3. Sets the date of for which the Act will take effect. Effective Date: September 1, 1997. SECTION 4. Emergency Clause.
