DIGEST 

Currently, Subsection (c) of Article 102.014, Code of Criminal Procedure,
is unenforceable.  In 1995, the legislature enacted Title 7C,
Transportation Code, to replace Article 67.01d, V.T.C.S. However,
corresponding changes were not make in Article 102.014(c), Code of
Criminal Procedure,. This bill will clarify Article 102.014(c), Code of
Criminal Procedure, to reflect changes made in 1995 to the Transportation
Code.   

PURPOSE

As proposed, H.B. 1018 clarifies court costs imposed on persons convicted
of certain offenses. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Article 102.014(c), Code of Criminal Procedure, to
require a person convicted of an offense under Title 7C, Transportation
Code, rather than Article 6701d, V.T.C.S., when the offense occurs within
a school crossing zone as defined by Section 541.302 of that code, to pay
as court costs $20 in addition to other taxable court costs.  Requires a
person convicted of an offense under Section 25.093 or 25.094, Education
Code, to pay as taxable court costs $20 in addition to other taxable court
costs.  Makes a conforming change. 

SECTION 2. Makes application of this Act prospective.

SECTION 3. Effective date: September 1, 1997.

SECTION 4. Emergency clause.
