DIGEST 

Currently, vehicle storage facilities charge a fee of $10 which covers
various services related to impoundment.  Currently, this fee is known as
a "preservation fee."  However, there is concern that the term
"preservation fee" does not accurately describe what services and expenses
are incurred when a vehicle is brought in and stored.  H.B. 1025 would
change the term "preservation fee" to "impoundment fee" in order to more
accurately describe the actions taken and expenses incurred when a vehicle
storage facility stores a vehicle. 

PURPOSE

As proposed, H.B. 1025 outlines provisions regarding certain fees charged
by vehicle storage facilities. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 2(7), Article 6687-9a, V.T.C.S. (Vehicle Storage
Facility Act), to define "impoundment." 

SECTION 2. Amends Section 14(d), Article 6687-9a, V.T.C.S., to prohibit
the operator of a vehicle storage facility from charging any additional
fees that are similar to notification, impoundment, rather than
preservation, or administrative fees. 

SECTION 3. Emergency clause.
  Effective date: upon passage.
