TWT H.B. 1025 75(R)BILL ANALYSIS TRANSPORTATION H.B. 1025 By: Bosse 2-28-97 Committee Report (Unamended) BACKGROUND Vehicle Storage Facilities currently charge a fee of $10 which covers the cost of taking an inventory of the vehicle brought in, running a motor vehicle registration to verify all information and know who the owners and lien holders are, paying the salary of an employee 24 hours a day to be on the grounds, and if needed, providing a tarp for the vehicle. "Impoundment Fee", rather than "Preservation Fee", is a more appropriate term for what is being required of Vehicle Storage Facilities to be able to charge this fee. "Impoundment" provides a broader term to include all services and expenses which are incurred when a vehicle is brought in and stored. This bill does not create a new or additional fee, it only changes the term for a current fee. PURPOSE The purpose of this bill is to change to the term "preservation fee" to "impoundment fee" which better describes the actions taken and expenses incurred when a vehicle storage facility takes in a vehicle. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2(7), Vehicle Storage Facility Act (Article 6687-9a, Revised Statutes), by changing the term "Preservation" to "Impoundment" which refers to the action taken by the owner or operator of a vehicle storage facility that is necessary to preserve, protect, or service a vehicle stored at that facility. SECTION 2. Amends Section 14(d), Vehicle Storage Facility Act (Article 6687-9a, Revised Statutes), by changing the word "preservation" to "impoundment". SECTION 3. Emergency Clause
