DIGEST 

Currently, there is a funding mechanism for county courts that sets out
certain salary standards for counties receiving funds from that mechanism.
There are provisions regarding judges who make less than $21,000 less than
a district judge in the same county.  The way these provisions were
drafted does not allow the commissioners courts of those counties to give
judges a raise without losing the county's funding under the funding
mechanism.  This bill will allow the commissioners court of counties whose
judges make more than $21,000 less than a district judge in the same
county as of May 1, 1991 to increase the salary of those judges without
losing funding. 

PURPOSE

As proposed, H.B. 1040 allows the commissioners court of counties whose
judges make more than $21,000 less than a district judge in the same
county as of May 1, 1991 to increase the salary of those judges without
losing funding. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 25.0005(e), Government Code, to provide that a
county is not required to meet the salary requirements of Subsection (a)
for a particular court if, among other requirements, the county pays at
least the salary required by Subdivision (1). 

SECTION 2. Emergency clause.
  Effective date: upon passage.
