BACKGROUND 

 House Bill 66, 72nd Regular Session, created a funding mechanism for
county courts and set out certain salary standards for counties receiving
funds from that mechanism.  In HB 66, provisions were made for judges who
made less than $21,000 less than a district judge in their county.  The
way this provision was drafted does not allow the commissioners courts of
those counties to give these judges a raise without losing the county's
funding provided under HB 66. 


PURPOSE

 The purpose of this bill is to allow the commissioners courts of counties
whose judges made more than $21,000 less than a district judge in their
county as of May 1, 1991, to increase the salary of those judges without
losing funding. 


RULEMAKING AUTHORITY

 It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 


SECTION BY SECTION ANALYSIS

 SECTION 1 amends Section 25.005(e) of the Government Code to allow the
commissioners courts of counties in which judges made less than $21,000
less than a district judge in their county as of May 1, 1991, to increase
the salary of those judges without losing funding. 

 SECTION 2.  Emergency Clause.  Effective date.
