SRC-CDH H.B. 1055 75(R) BILL ANALYSIS Senate Research Center H.B. 1055 By: Tillery (Carona) State Affairs 5-18-97 Engrossed DIGEST Currently, a juvenile may obtain a driver's license despite the fact that he or she has failed to appear in court or pay a fine in connection with a misdemeanor. H.B. 1055 extends the Department of Public Safety's authority to deny a license to juveniles for all outstanding delinquent misdemeanors punishable by fine. PURPOSE As proposed, H.B. 1055 establishes provisions regarding denial of a driver's license to a juvenile for failure to appear in court or pay a fine in connection with a misdemeanor. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 521.201, Transportation Code, to prohibit the Department of Public Safety from issuing any license to a person who has been reported by a court for failure to appear or default in payment of a fine for a misdemeanor that is not covered under Subdivision (7) and that is punishable by a fine only, including a misdemeanor under a municipal ordinance, committed by a person who was under 17 years of age at the time of the alleged offense, unless the court has filed an additional report on final disposition of the case. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
