Committee Report (Unamended)

BACKGROUND

Currently, a juvenile may obtain a driver's license despite the fact that
he/she failed to appear in court or pay a fine in connection with a
misdemeanor.

PURPOSE

As proposed, House Bill 1055 extends the department's authority to deny a
license to juveniles for all outstanding delinquent misdemeanors
punishable by fine.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution.

SECTION BY SECTION ANALYSIS

Section 1. Sec. 521.201 of the Transportation Code is amended by adding
Subdivision (8) stating that a juvenile is ineligible for a license if the
alleged offense was committed by the juvenile while under the age of 17
and, if he/she has been reported by a court for failing to appear or
default in payment of a fine for all misdemeanors punishable by fine.

Section 2. States that the effective date is September 1, 1997.

Section 3. Emergency Clause.
