SCT H.B. 1062 75(R)BILL ANALYSIS STATE FEDERAL & INTERNATIONAL RELATIONS H.B. 1062 By: Hunter 4-7-97 Committee Report (Unamended) BACKGROUND Gives the Texas State Library and Archives Commission authority to obtain criminal history information from the Texas Department of Public Safety directly. The commission employs staff who have access to valuable state archival records and to the stored confidential records of other state agencies. The commission should be able to make sure that someone they employ does not have criminal history that would put the Library or Archives at risk. This amendment would give the commission the same authority enjoyed by many other state agencies with security-sensitive positions. PURPOSE This legislation allows the State Library and Archives Commission authority to obtain criminal history information. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter F, Chapter 411, Government Code. Allows the TSL&A to obtain from the DPS criminal history records relating to a person employed in or applying to a security-sensitive position, and it defines that position within the commission. SECTION 2. Sets the date for which the Act will take effect. Effective date:September 1, 1997. SECTION 3. Emergency Clause.
