JH H.B. 1161 75(R)BILL ANALYSIS URBAN AFFAIRS H.B. 1161 By: Clark 3-6-97 Committee Report (Unamended) BACKGROUND Local Government Code Section 252.021 and Section 271.021 both apply to municipalities. This causes confusion because of overlapping and duplicative bidding requirements. PURPOSE This bill would eliminate duplication and confusion by making Section 271.021 et. seq. no longer applicable to municipalities. Municipalities would still be governed by the more complete bidding procedures of Section 252.021, et. seq. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 271.021 (2), Local Government Code, by striking Subsection B. SECTION 2. Repeals Section 271.023, Local Government Code relating to the contrary city charter provisions. SECTION 3. Effective date: September 1, 1997, and applies only to a contract for which a municipality first solicits bids or proposals on or after that date. SECTION 4. Emergency clause.
