DIGEST 

Currently, the Municipal Solid Waste Management and Resource Recovery
Advisory Council (council) exists to advise the Municipal Solid Waste
Management Program.  The council is currently composed of six elected
officials and 11 members representing a variety of constituencies and the
public, some constituencies may no longer need representation, while other
constituencies may not be represented.  This bill updates the requirements
for the composition of the council. 

PURPOSE

As proposed, H.B. 1206 updates the requirements for the composition of the
Municipal Solid Waste Management and Resource Recovery Advisory Council.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 363.041, Health and Safety Code, as follows:

Sec. 363.041. COMPOSITION OF ADVISORY COUNCIL.  Provides that the
Municipal Solid Waste Management and Resource Recovery Advisory Council
(council) is composed of 18, rather than 17, members.  Deletes a provision
providing that a member of the Texas Natural Resource Conservation
Commission (commission) is a member of the council. Provides that a
registered waste tire processor, rather than a registered fixed waste tire
processor, is a member of the council.  Provides that a professional
engineer from a private engineering firm with experience in the design and
management of solid waste facilities, a solid waste professional with
experience managing or operating a commercial solid waste landfill, and a
person who is experienced in the management and operation of a composting
or recycling facility or an educator with knowledge of the design and
management of solid waste facilities are members of the council.  Deletes
a provision providing that a registered, mobile waste tire processor is a
member of the council. 

SECTION 2. Amends Section 363.044, Health and Safety Code, as follows:

Sec. 363.044. PAYMENT OF AND REIMBURSEMENT FOR EXPENSES.  Provides that
each advisory council member is entitled to compensation and reimbursement
of travel expenses incurred by the member while conducting the business of
the advisory council, as provided in the General Appropriations Act.
Deletes a provision providing that each advisory council member other than
the member representing the commission is entitled to $50 for each council
meeting the member attends and the travel allowance provided by the
General Appropriations Act for state employees.  Deletes a provision
providing that the member representing the commission is to be entitled to
receive the same per diem and travel allowance the member receives for
commission meetings.  

SECTION 3. Effective date: September 1, 1997.
  Makes application of this Act prospective.

 SECTION 4. Emergency clause.
