SRC-JFA H.B. 1229 75(R) BILL ANALYSIS Senate Research Center H.B. 1229 By: Counts (Fraser) Criminal Justice 5-10-97 Engrossed DIGEST In Texas, district attorneys may maintain an independent law practice to supplement their pay unless they are listed in the Professional Prosecutors Act, which provides additional state funding to supplement existing salaries in exchange for prohibiting the prosecutor from the private practice of law. Only about 20 elected prosecutors in Texas are not subject to the Professional Prosecutors Act. This bill would add the 32nd Judicial District Attorney to the Professional Prosecutors Act. PURPOSE As proposed, H.B. 1229 adds the 32nd Judicial District Attorney to the Professional Prosecutors Act. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002, Government Code, to provide that Chapter 46, relating to professional prosecutors, applies to the district attorney for the 32nd Judicial District, among other prosecutors. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
