MAD C.S.H.B. 1237 75(R) BILL ANALYSIS ELECTIONS C.S.H.B. 1237 By: Junell 4-29-97 Committee Report (Substituted) BACKGROUND Currently, the law requires each election precinct to hire enough personnel to ensure that the primary elections will be properly held. Section 173.008(c) of the Election Code states that of these election workers, the state may compensate a minimum of two election clerks in each precinct. PURPOSE As proposed, this legislation would increase the number of election clerks compensated by the state from two to three for each election precinct containing 1,000 or more registered voters. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends Section 173.008(c), Election Code, to increase the minimum number of election clerks per election precinct payable with state funds from two to three for each election precinct containing 1,000 or more registered voters. SECTION 2: Effective date of September 1, 1997. SECTION 3: Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE SECTION 1: The original raised the number of clerks that could be state compensated from two to three in all precincts. The substitute raises the number of clerks that can be state compensated to three clerks only in precincts containing 1,000 or more registered voters.
