SRC-JRN H.B. 1254 75(R) BILL ANALYSIS Senate Research Center H.B. 1254 By: Jackson (Patterson) Intergovernmental Relations 5-5-97 Engrossed DIGEST In the 74th Legislative Session, H.B. 2177 was passed to validate the acts of navigation districts in an attempt to avoid frivolous law suits. Public port authorities were not included in H.B. 2177. This bill adds port authorities to the navigation act that was passed during the 74th Legislative Session. PURPOSE As proposed, H.B. 1254 validates all acts, governmental proceedings, officials, bonds, and obligations of navigation districts and port authorities. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. DEFINITION. Defines "district" to mean a navigation district or a port authority created under Section 52, Article III, or Section 59, Article XVI, Texas Constitution, or other public port authority. SECTION 2. VALIDATION. Sets forth acts, governmental proceedings, persons, and types of obligations that are validated and confirmed in all respects. SECTION 3. APPLICABILITY. Sets forth acts, proceedings, persons, and obligations to which SECTION 2 of this Act does not apply. SECTION 4. Emergency clause. Effective date: upon passage.
