DIGEST 

Currently, Section 272.001(a), Local Government Code, regarding the sale
or exchange of land inaccurately refers to an exception provided by
Section 253.007, Local Government Code, which refers to the sale of
computer software.  H.B. 1296 would remove the inaccurate reference,
thereby eliminating misunderstandings as to the intent of the law. 
  
PURPOSE

As proposed, H.B. 1296 outlines provisions regarding the notice of a sale
or an exchange of land by a political subdivision. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 272.001(a), Local Government Code, to require
notice to the general public of the offer of land owned by a political
subdivision for sale or exchange to be published in a newspaper of general
circulation in either the county in which the land is located or, if there
is no such newspaper, in an adjoining county, except as provided by
Section 253.008, rather than Section 253.007. 

SECTION 2. Emergency clause.
  Effective date: upon passage.
