TWT H.B. 1320 75(R)BILL ANALYSIS TRANSPORTATION H.B. 1320 By: Talton 4-3-97 Committee Report (Unamended) BACKGROUND Under current law, when a vehicle is stored at a vehicle storage facility (VSF), the owner or representative of the owner of the vehicle can drive the vehicle off the premises by presenting an affidavit of ownership. The affidavit requirements must be notarized and include the name of the owner, description of car and vehicle identification number. Anyone posing as a representative of the vehicle could forge the information and wrongly obtain possession of the vehicle. PURPOSE As proposed, this bill will require the license holder of a vehicle storage facility to request evidence of financial responsibility, as well as an affidavit, from the owner or representative of the vehicle, before allowing the vehicle to be driven from the facility. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 9, Vehicle Storage Facility Act (Article 6687-9a, Revised Statutes), by adding Subsection (e) which requires the owner or representative of the owner of the vehicle to provide proof of financial responsibility before driving the vehicle off the premises of the facility. Prevents a VSF license holder from operating unless this occurs. SECTION 2. Emergency Clause.
