AEZ H.B. 1323 75(R)BILL ANALYSIS CRIMINAL JURISPRUDENCE H.B. 1323 By: Luna, Vilma 4-17-97 Committee Report (Unamended) BACKGROUND County attorneys, district attorneys, or criminal district attorneys may collect fees from any person who is a party to processing a dishonored or forged check. Currently, the amount of the fee collected may not exceed $5, if the face amount of the check does not exceed $10. If the face value of the check is greater than $10 but less that $100, the processing fee collected is $10. PURPOSE HB 1323, as proposed, would increase the fees collected from someone who is a party to processing a dishonored or forged check. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 102.007 (c), Code of Criminal Procedure to increase the amount of fees collected from $5 to $10 on checks not exceeding $10 in value and increase from $10 to $15 on checks greater than $10 but not exceeding $100 in value. SECTION 2. Effective Date: September 1, 1997. Applies only to a check or sight order issued on or after the effective date. SECTION 3. Emergency Clause.
