SRC-SLL H.B. 1384 75(R) BILL ANALYSIS Senate Research Center H.B. 1384 By: Telford (Ratliff) Finance 5-7-97 Engrossed DIGEST Currently, the Education Code provides that a nonresident student who is a resident of a state adjacent to Texas and who registers in any Texas public junior college or public technical school located in a county adjacent to the nonresident's home state shall pay tuition in an amount equal to the amount charged a Texas resident registered in a similar school in the nonresident's state. This bill will include public upper-level institutions of higher education among those institutions not applying the nonresident tuition fee to a nonresident student residing in bordering states. PURPOSE As proposed, H.B. 1384 includes public upper-level institutions of higher education among those institutions not applying the nonresident tuition fee to a nonresident student residing in bordering states. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 54.060(a), Education Code, to provide that the nonresident tuition fee prescribed by this chapter does not apply to a nonresident student who is a resident of Arkansas, Louisiana, New Mexico, or Oklahoma and who registers in a public upper-level institution of higher education that is situated in a county immediately adjacent to the state in which the nonresident student resides. Defines "public upper-level institution of higher education." Deletes existing text regarding equivalent fees and charges. Makes nonsubstantive changes. SECTION 2. Provides that this Act applies beginning with tuition charged for the 1997 fall semester. SECTION 3. Emergency clause. Effective date: upon passage.
