BWH H.B. 1475 75(R)BILL ANALYSIS COUNTY AFFAIRS H.B. 1475 By: Bonnen 3-21-97 Committee Report (Unamended) BACKGROUND In many counties, the county treasurer is the sole person authorized to execute certain financial responsibilities. Therefore, if the county treasurer is unable to perform these duties, the county's obligations may not be met on a timely basis. PURPOSE This bill would authorize the a county treasurer, in a county without a deputy county treasurer, to appoint a person to act in the treasurer's place if the treasurer is absent, unavoidably detained, incapacitated, or unable to act. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. This section amends Section 83.005(a), Local Government Code, to authorize a county treasurer, in a county without a deputy county treasurer, to appoint a person to act in place of the county treasurer only if the treasurer is absent, unavoidably detained, incapacitated, or unable to act. Amends Section 83.005(d) by striking "d", adding "c", and amending subsection to prohibit an appointed person other than a regularly employed county employee from receiving compensation in connection with that person's actions on behalf of the county treasurer. SECTION 2. Effective date of this bill would be September 1, 1997. SECTION 3. Emergency clause.
