NDT H.B. 1703 75(R)BILL ANALYSIS LICENSING & ADMINISTRATIVE PROCEDURES H.B. 1703 By: Torres 3-24-97 Committee Report (Unamended) BACKGROUND Currently, owners of businesses who desire to alter the form of business under which such a permit or license is held must apply for a new permit or license. PURPOSE To allow owners who desire to alter the form of their business to do so without re-permitting. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Allows the holder of a permit to alter the form of business entity by giving notice to the Alcoholic Beverage Commission and paying a fee of $100 if the ownership interest in the entity is identical to the ownership of the former entity. SECTION 2. Allows the holder of a license to alter the form of business entity by giving notice to the Alcoholic Beverage Commission and paying a fee of $100 if the ownership interest in the entity is identical to the ownership of the former entity. SECTION 3. Effective date. September 1, 1997. SECTION 4. Emergency clause.
