JWW C.S.H.B. 1736 75(R)BILL ANALYSIS PUBLIC SAFETY C.S.H.B. 1736 By: McClendon 4-7-97 Committee Report (Substituted) BACKGROUND Sex offenders convicted after September 1, 1995, are required to register with local law enforcement authorities within seven days of moving into a new community. The local law enforcement agencies are then required to place a one day add in the legal notices section of the local newspaper. This add contains the sex offender's age, gender, a brief description of their offense, and the municipality, street name, and zip code of the offender's new place of residence. This information is also required to be given to the superintendent of schools where the sex offender is moving, but current law does not state what the superintendent is supposed to do with that information. PURPOSE To require that the superintendent of schools release a sex offenders notice to the appropriate school personnel. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3(e), Article 6252-13c.1, Revised Statutes, so that upon reception of a notice under this subsection, the superintendent shall release the information given in the notice to the appropriate school district personnel to include: peace officer and security personnel, principals, nurses and counselors. SECTION 2. Amends Section 4(f), Article 6252-13c.1, Revised Statutes, so that upon reception of a notice under this subsection, the superintendent shall release the information given in the notice to the appropriate school district personnel to include: peace officer and security personnel, principals, nurses and counselors. SECTION 3. Effective Date: September 1, 1997. SECTION 4. Emergency Clause. COMPARISON OF ORIGINAL TO SUBSTITUTE SECTION 1 The substitute adds peace officers and security personnel, principal, nurses, and counselor to the list of school district personnel to be notfied by the superintendent.
