IMF H.B. 1782 75(R)BILL ANALYSIS STATE AFFAIRS H.B. 1782 By: Counts 4-3-97 Committee Report (Unamended) BACKGROUND Under current law and General Service Commission rules, the Veteran's Land Board is required to use competitive bidding to enter into real estate appraisal contracts. As a result, they have had to rebid several contracts because of inferior work done by low bidders. Allowing the Veteran's Land Board to choose their own appraisers based on qualifications specific to the type of work that is involved could save a great deal of time and money. PURPOSE To include real estate appraisal and certified general, certified residential, or state licensed appraiser in the definition of professional services as defined in Section 2254.002, Government Code. This change would allow agencies to choose appraisers rather than rely on competitive bidding. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Title 10, Chapter 2254, Government Code is amended as follows: Sec. 2254.002 (2). Definitions. Adds real estate appraising to the list of professional services. Adds state certified or state licensed real estate appraisers to the list of licensed professional employment. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
