However, the comptroller of public accounts recommended in a 1996 report that DIR develop a training program for state employees concerning contract negotiation for information resources. While DIR includes contract negotiation in its current training curriculum, this bill requires DIR to provide training for state employees concerning contract negotiation, and directs the General Services Commission to place vendor catalogues on the Internet. PURPOSE As proposed, H.B. 1805 requires the Department of Information Resources to provide training for state employees concerning contract negotiation, and directs the General Services Commission to place vendor catalogues on the Internet. RULEMAKING AUTHORITY Rulemaking authority is granted to the General Services Commission in SECTION 3 (Section 2157.066(d), Government Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 2054C, Government Code, by adding Section 2054.060, as follows: Sec. 2054.060. TRAINING IN CONTRACT NEGOTIATION. Requires the Department of Information Resources (DIR), in cooperation with the comptroller, the General Services Commission (commission), and other appropriate state agencies to develop and implement a program to train state agency personnel in effectively negotiating contracts for the purchase of information resources technologies. Requires DIR to make the training available to certain state agency personnel. Sets forth requirements to be included in the training by DIR. Authorizes DIR to use its own staff or contract with private entities or other state agencies to conduct the training. SECTION 2. Amends Section 2157.062(a), Government Code, to authorize the commission to allow or require a vendor to apply on-line. SECTION 3. Amends Section 2157.066, Government Code, as follows: Sec. 2157.066. CATALOGUE REQUIREMENTS. Requires vendors designated by the commission to publish and maintain catalogues as described by Section 2157.062(b)(1) in the manner required by the commission. Requires the vendor to make the revisions in the catalogue available in the manner required by the commission. Deletes a requirement for the vendor to forward to the commission and all eligible purchasers a copy of each revised catalogue. Sets forth provisions regarding the requirements for the commission to make the catalogue information available on the world wide web. Requires the commission to prescribe requirements and the timing of requirements, by rule. Defines "Internet." SECTION 4. Requires the comptroller, with the cooperation of other appropriate state agencies, to evaluate and determine the extent to which it would be advantageous to the state for other goods and services to be procured. Requires the comptroller to report the findings and determinations to the general investigating committees of each house of the legislature. SECTION 5. Requires DIR to consult the California Franchise Tax Board (board) about the manner in which the board purchases information resources technologies and structures its contracts for the purchase of those technologies. Requires DIR to include information about the practices in its training program, if DIR determines that the practices of the board can be incorporated into its training program. SECTION 6. Effective date: September 1, 1997. SECTION 7. Emergency clause.
