DIGEST 

Currently, the Lamar County Juvenile Board consists of the county judge
and the district judges in Lamar County.  Although the Texas Juvenile
Probation Commission has promulgated rule 341.4(d) requiring county
juvenile probation employees to be paid on the same pay scale as state
adult probation employees, neither the state nor the commission has
provided funds to pay the salaries. C.S.H.B. 1891 would add the Lamar
County Court at Law Judge to the board and give the county commissioners
court the authority to set the salaries and rate of increase in salaries
for juvenile probation officers and employees. 

PURPOSE

As proposed, C.S.H.B. 1891 outlines provisions regarding the Lamar County
Juvenile Board. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 152.1451, Human Resources Code, to set forth the
composition of the Lamar County Juvenile Board (board).  Requires the
board to elect one of its members as chairman at its first regular meeting
of each fiscal year.  Requires the board to hold regular meetings each
year on dates set by the board and special meetings at the call of the
chairman.  Deletes text naming the court judge as board chairman and its
chief administrative officer.  Provides that service on a juvenile board
by a judge is an additional duty of office.  Authorizes the commissioners
court to pay the board chairman and other board members additional
compensation, rather than $2,400, for the additional, rather than added,
duties imposed on the chairman and the other board members. Deletes text
regarding compensation of board members.  Requires the board to recommend
the commissioners court proposed salaries for juvenile probation officers
and other juvenile probation employees.  Requires the commissioners court
to set the salaries of juvenile probation officers and other juvenile
probation employees after considering the recommendation of the board and
any other relevant factors, including the source of funds, the duties and
workloads of the employees, and the effect on other county employees.
Requires the commissioners court to comply with all applicable laws when
setting the salaries of juvenile probation officers and other juvenile
probation employees. Makes a conforming change. 

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
