DIGEST 

Currently, the Department of Public Safety (department) is required to
notify certain individuals of the license suspension by certified mail.
In order for the suspension to take effect, the person whose license is
being suspended must sign the return receipt that accompanies the
certified letter.  There are concerns that persons affected by this
suspension can avoid having their licenses suspended by simply not signing
the receipt.  This bill requires the department to notify a person of
suspension of a license by regular mail to the last known address of this
person. 

PURPOSE

As proposed, H.B. 1937 sets forth provisions regarding a notice to an
owner or operator of a motor vehicle of security required following an
accident. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 601.155, Transportation Code, by amending
Subsection (c) and adding Subsection (d), to delete a provision requiring
a notice under this section to be mailed by certified mail, return receipt
requested, to a person's last known address, as shown by the Department of
Public Safety's (department) records.  Provides that a notice is presumed
to be received if the notice was mailed to the person's last known
address, as shown by the department's records.   

SECTION 2. Effective date: September 1, 1997.
