DIGEST 

Currently, the executive director of the Texas Parks and Wildlife
Department is allowed to suspend or revoke an original or renewal permit
or license issued under the Parks and Wildlife Code in certain
circumstances.  This bill allows any hunting or fishing licence or permit
issued by the Texas Parks and Wildlife Department  to be automatically
revoked upon conviction of poaching.   

PURPOSE

As proposed, C.S.H.B. 1941 sets forth provisions regarding poaching;
provides a penalty.   

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 12.101(2), Parks and Wildlife Code, to redefine
"contraband." 

SECTION 2. Amends Sections 12.1106(a) and (b), Parks and Wildlife Code, to
require a warden or officer to give notice of a seizure to the county
judge or a judge of a county court at law or district court of the county
where the seizure occurred when a person pleads guilty or nolo contendere
to, is convicted of, or is placed on deferred adjudication for an offense
under Section 61.022.  Makes conforming changes. 

SECTION 3. Amends Section 61.022, Parks and Wildlife Code, to provide that
no person may hunt or catch by any means or method or possess a wildlife
resource, rather than game animal or game bird, fish, marine animal, or
other aquatic life, under certain conditions.  Sets forth provisions
regarding a violation of Subsection (a).  

SECTION 4. Amends Chapter 12F, Parks and Wildlife, by adding Section
12.5015, as follows: 

Sec.  12.5015.  AUTOMATIC REVOCATION OF HUNTING OR FISHING LICENSE OR
PERMIT.  Sets forth provisions regarding the revocation or suspension of a
hunting or fishing license or permit by the Texas Parks and Wildlife
Department under certain conditions.   

SECTION 5. Effective date: September 1, 1997.
  Makes application of this Act prospective.

SECTION 6. Emergency clause.
  







 SUMMARY OF COMMITTEE CHANGES

Adds new SECTIONS 1-3, redesignates proposed SECTION 1 as new SECTION  4,
and renumbers existing sections accordingly. 

SECTION 1.

Amends Section 12.101(2), Parks and Wildlife Code, to redefine

Amends Sections 12.1106(b) and (d), Parks and Wildlife Code, to add
Section 61.022  to the list of offenses that are described under this
section. 

SECTION 3. 

Amends Section 61.022, Parks and Wildlife Code, to set forth provisions
for a person who violates this section. 

SECTION 4. 

Amends Chapter 12F, Parks and Wildlife Code, to provide a new heading for
this section. Sets forth provisions regarding a suspension under this
section. 

Adds SECTION 5 to set forth the effective date and make the application of
this Act prospective. 

Adds SECTION 6 to set forth the emergency clause.
