Page HB 2005CJ H.B. 2005 75(R)BILL ANALYSIS JUVENILE JUSTICE & FAMILY ISSUES H.B. 2005 By: Thompson 4-17-97 Committee Report (Unamended) BACKGROUND Section 153.433, Family Code, currently states that the court may order reasonable visitation rights to either maternal or paternal grandparents of a child when the grandparent meets certain criteria, and access is in the best interest of the child. The court now has the option of granting the visitation of grandchildren by their grandparents, which can negatively affect the grandchild and grandparent when access is not allowed to a grandparent who meets certain criteria. PURPOSE The purpose of this bill is to grant grandparents reasonable access to their grandchildren if they meet certain criteria of 153.433, Family Code. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION-BY-SECTION ANALYSIS SECTION 1. Amends Section 153.433, Family Code, to read the court shall order reasonable access to a grandchild by a grandparent if certain criteria are met. SECTION 2.
