TWT H.B. 2067 75(R)BILL ANALYSIS TRANSPORTATION H.B. 2067 By: Swinford 4-5-97 Committee Report (Substituted) BACKGROUND Currently, proof of financial responsibility is required for vehicle registration and title. However, no such provision exists for temporary vehicle registration. As it stands now, a person may continue to obtain temporary permits on a monthly basis without providing proof of financial responsibility. PURPOSE As proposed, C.S.H.B. 2067 would require anyone obtaining a temporary permit to provide proof of financial responsibility. RULEMAKING AUTHORITY It is the committee's opinion that this bill does grant any additional rulemaking authority to the Texas Department of Transportation (TXDOT) in Section 1 (Sec. 502.354 (i)). SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 502.354, Transportation Code, by amending Subsection (e) and adding Subsection (i). (e)(1)(B) Allows a single or 30-day trip permit to be obtained at any vehicle title and registration regional office. (e)(3) Requires proof of financial responsibility for a temporary permit. (i) Allows the TXDOT to adopt rules to carry out the new provision and to prescribe an application for a permit and other forms. SECTION 2. Emergency clause. Effective upon passage. COMPARISON OF ORIGINAL TO SUBSTITUTE The only change is in SECTION 1, Subsection (e)(3) of the substitute which deletes the requirement for complying with Section 601.168(a), Transportation Code (Insurance Policy or Bond; Limits). Sec. 601.168(a) is unnecessary for the intent of the bill. Sec. 502.354, Transportation Code, directly lists all requirements for proof of financial responsibility.
