BACKGROUND 

As provided by Section 1761(c) of Title 18, United States Code (U.S.C.),
the Texas Youth Commission is certified by the Bureau of Justice
Assistance as having met all statutory eligibility requirements for
certification under the Private Sector/Prison Industry Enhancement
Program. Pursuant to this certification, the Texas Youth Commission may
contract with agencies of the Federal Government pursuant to 41 U.S.C.
1761 (c) for the sale of goods purchased under the terms of the
certification. 

Pursuant to the terms of the certification of TYC Youth Industries
Program, the statutory and guideline criteria require that TYC withhold
from the wages of any TYC youth employed under this program a contribution
for victim's compensation fund.  That contribution can be from 5% to 20%
of the youth's gross wages. 

PURPOSE

H.B. 2153 clarifies the Texas Youth Commission's authority to apportion
wages earned by TYC youth in PIE Certified Youth Industries Program for
contribution to a crime victim's compensation fund. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 61.123, Human Resources Code, by adding a new
subdivision (3) which adds compensation to the victims of crime fund or
compensation to the victims of crime auxiliary fund to the prioritized
list of apportioned wages earned by a child working under the Texas Youth
Commission Youth Industries Program.
