ACG H.B. 2170 75(R)BILL ANALYSIS ENVIRONMENTAL REGULATION H.B. 2170 By: Kubiak 3-18-97 Committee Report (Unamended) BACKGROUND The Department of Health is required to collect fees for radioactive material licenses and registrations. The current minimum fee for failure to pay on time is fixed statutorily at $100, however many small licensees (dentists, veterinarians) have an annual fee as low as $100. An added late fee doubles the cost for small time operators. PURPOSE To lower the minimum amount for late fees in order to have more equity between the small operators and large corporate operators. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 401.301 (c), Health and Safety to change the minimum late fee from $100 to not less than twenty percent of the amount of the annual license and registration. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency Clause.
