BACKGROUND 

Texas A&M University has built four Centers for Housing and Urban
Development (CHUD) in colonias along to U.S. - Mexico border.  These
centers help colonia residents access services provided by the government,
private industry, and nonprofit  organizations.  CHUDs  serve as "onestop"
locations for a variety of social and educational services.  


PURPOSE

CSHB 2252 will increase funding to  a variety of programs that are to be
administered by Texas A&M through the Centers for Housing and Urban
Development.  

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS


SECTION 1.  Subchapter C, Chapter 40, Human Resources Code is amended by
adding Section 40.066 as follows: 

Sec. 40.066.  ACCOUNT FOR PROVISION OF SERVICES TO RESIDENTS OF COLONIA.
Directs the Department of Protective and Regulatory Services  to use
$500,000 of federal money for community based services in colonias.   The
department may contract with Texas A&M University to provide services
eligible under this section. 

SECTION 2.  Amends Subchapter B, Chapter 481 Government Code by adding
Section 481.030 as follows: 

Section 481.030.  ACCOUNT FOR PROJECTS AND PROGRAMS TO ASSIST RESIDENTS OF
COLONIA.  Directs the Department of Commerce to use $600,000 of CDBG funds
to construct and rehabilitate community centers; establish a loan program
for small business; provide loan management and business training; and
provide for administration of the these funds.  The department may
contract with Texas A&M University  to provide services eligible under
this section. 


SECTION 3.  Amends Subchapter I, Chapter 201, Transportation Code by
adding Section 201.705  as follows: 

Section 201.705.  ACCOUNT FOR PROJECTS IN COLONIAS.  Directs the state to
use 5 percent of the federal money received by the state as Transportation
Enhancement Funds under the Internodal Surface Transportation Efficiency
Act of 1991 for use in Colonias.  The funds are to be used for colonia
projects which are eligible for federal reimbursement.  The department may
contract with Texas A&M University  to provide services eligible under
this section. 


SECTION 4.  Amends Section 24.005, Parks and Wildlife Code, by adding
Subsections (d) and (e) as follows: 

 (d) Directs the Department of Parks and Wildlife to grant $400,00 each
year to counties where Colonias are found  to provide funding for
recreational facilities.  The department may consult with Texas A&M
University  to provide services eligible under this section. 

SECTION 5.  Directs the comptroller to transfer funds into an account
established in Section 3. 

SECTION 6.  Effective date.

COMPARISON OF ORIGINAL TO SUBSTITUTE

SECTION 1.  HB 2252 directs the comptroller to deposit $500,000 into a
separate account, money received under Title XX of the Social Security Act
for community based services.  CSHB 2252 directs the Department of
Protective and Regulatory Services to use  $500,000 of federal money for
community based services. 

SECTION 2.  HB 2252 directs the comptroller to deposit $600,000 into a
separate account money received under CDBG  to implement programs.  CSHB
2252 directs the Department of Commerce to use $600,000 of CDBG money to
implement programs.  

SECTION 3.  HB 2252 directs the comptroller to deposit five percent of
federal money received under the Intermodal Surface Transportation
Efficiency Act of 1991 in to an account in general revenue  for various
projects.  CSHB 2252 directs that the state use five percent of federal
money received under the Intermodal Surface Transportation Efficiency Act
of 1991 for projects in colonias. 

SECTION 4.  HB 2252 directs the Department of Parks and Wildlife to use at
least $400,000 in counties in which colonias are located to provide
one-half the costs for recreational or sports parks. CSHB 2252 includes a
provision to allow counties to meet requirements for participation by
using cash or in-kind contributions.  CSHB 2252 also requires that the
department consult with Texas A&M on eligible projects.
