DIGEST 

Currently, the commissioners court regulates the security 
policies of county courthouses.  In some 
instances certain elected officials have authorized themselves 
and their staff to circumvent county 
courthouse security procedures.  This bill requires any employee 
of the county or any county officer 
to participate in any county courthouse security program.  

PURPOSE

As proposed, H.B. 2285 sets forth provisions regarding the 
ability of the commissioners court of a 
county to determine county courthouse security policies.

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a 
state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 291.003, Local Government Code, as 
follows:

Sec.  291.003.  CONTROL OF COURTHOUSE AND COURTHOUSE 
SECURITY 
POLICY.  Authorizes the commissioners court of a county to 
regulate participation in any 
county  courthouse security program and to require any 
employee of the county or any county 
officer to participate in any county courthouse security 
program, including a program in 
which a metal detector or X-ray security system is used.

SECTION 2. Emergency clause.
  Effective date:  upon passage.
