BACKGROUND 

When a state-owned facility is under the control of a certain state
agency, and that agency chooses to relinquish control of the building, the
property is held by the General Land Office and maintained by the General
Services Commission, until transferred to the control of another entity.
The state-owned building at 125 Lehmann Drive in Kerrville, Texas, is
currently under the control of the Texas Railroad Commission.  In 1993,
the State Comptroller gave up control of the building to the Railroad
Commission, which planned to use the site for training seminars. The
Railroad Commission has not used the facility as it planned, and no longer
wishes to exercise control of the building. 

Moving control of the building to the Upper Guadalupe River Authority
facilitates the development of surplus state property into a multi-agency
resource dedicated to the enhancement, preservation, and protection of
natural resources in the Texas Hill Country.  This move would consolidate
multiple agency resources and facilitate coordinated cooperative
activities in a manner that reduces each individual entity's annual
expenditures of taxpayer monies. 

PURPOSE

HB 2318 transfers control of the state-owned building at 125 Lehmann Drive
in Kerrville from the control of the Texas Railroad Commission to the
control of the Upper Guadalupe River Authority, for development of the
facility as the Guadalupe Basin Natural Resources Center.  

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Transfers the charge, control, and any related records of the
state building and grounds located at 125 Lehmann Drive in Kerrville from
the Railroad Commission of Texas to the Upper Guadalupe River Authority. 

SECTION 2. Effective date:  September 1, 1997.

SECTION 3. Emergency clause.

EXPLANATION OF AMENDMENTS

Committee Amendment No.  1  by:  Howard

This amendment adds a new SECTION 2 and renumbers succeeding sections
accordingly.  The amendment states that nothing shall be construed as
transferring title to the state building nor the land belonging to the
permanent school fund to the Upper Guadalupe River Authority.
