Often, these entities continue to exist long after their mission has been completed. H.B. 2380 would abolish the following advisory committees: the Uniform Statewide Accounting Project, the Boll Weevil Advisory Committee, the Runnels County Water Authority, the State Depository Board, the Egg Marketing Advisory Board, the Electronic Data Base Advisory Committee, the Energy Advisory Committee, the Rio Grande Valley Municipal Water Authority, and the Rio Grande Valley Pollution Control Authority. PURPOSE As proposed, H.B. 2380 would abolish the Uniform Statewide Accounting Project, the Boll Weevil Advisory Committee, the Runnels County Water Authority, the State Depository Board, the Egg Marketing Advisory Board, the Electronic Data Base Advisory Committee, the Energy Advisory Committee, the Rio Grande Valley Municipal Water Authority, and the Rio Grande Valley Pollution Control Authority. RULEMAKING AUTHORITY Rulemaking authority is granted to the comptroller in SECTION 4.12 (Section 404.033, Government Code), SECTION 4.18 (Section 2257.046(c), Government Code), and SECTION 4.20 (Section 154.051(k), Tax Code) of this bill. SECTION BY SECTION ANALYSIS ARTICLE 1. ABOLITION OF UNIFORM STATEWIDE ACCOUNTING PROJECT ADVISORY COMMITTEE SECTION 1.01. Abolishes the uniform statewide accounting project. SECTION 1.02. Amends Section 2101.031(b), Government Code, to delete a provision requiring the project to include components as developed or revised by the project advisory committee. SECTION 1.03. Amends Section 2101.035(d), Government Code, to make a conforming change. SECTION 1.04. Amends Section 2101.038, Government Code, to make a conforming change. SECTION 1.05. Amends Section 2101.039, Government Code, to provide that contracts made under this subchapter are not subject to Subtitle D, rather than Article 601b, V.T.C.S. Deletes existing Subsection (b). SECTION 1.06. Repealer: Section 2101.032, Government Code (Project Advisory Committee). ARTICLE 2. ABOLITION OF BOLL WEEVIL SECTION 2.01. Abolishes the boll weevil advisory committee. SECTION 2.02. Amends Section 74.108(a), Agriculture Code, to delete Subsection (a)(8). SECTION 2.03. Repealer: Section 74.120(d), Agriculture Code (Authority to Adopt Rules). ARTICLE 3. ABOLITION OF RUNNELS COUNTY WATER AUTHORITY SECTION 3.01. Abolishes the Runnels County Water Authority. SECTION 3.02. Repealer: Chapter 376, Article 8280-176, V.T.C.S. ARTICLE 4. ABOLITION OF STATE DEPOSITORY BOARD SECTION 4.01. Abolishes the State Depository Board (board). SECTION 4.02. Amends Sections 44.007(f)-(i), Agriculture Code, to set forth provisions regarding the comptroller, rather than the state treasurer. Makes conforming changes. SECTION 4.03. Amends Section 404.013, Government Code, to authorize the comptroller to adopt rules, rather than the board. SECTION 4.04. Amends Sections 404.021(a)-(c), Government Code, to make conforming changes. SECTION 4.05. Amends Sections 404.0212(b), (d), (e), and (f), Government Code, to make conforming changes. SECTION 4.06. Amends Section 404.022, Government Code, to delete a provision providing that the treasurer is the secretary of the board. Deletes a provision requiring the board to meet on the first Monday in August of each odd numbered year and at other appropriate times to consider applications. Deletes a provision authorizing the treasurer to give an eligible institution contingent approval as a depository until the board's next scheduled meeting. Makes conforming changes. SECTION 4.07. Amends Section 404.023, Government Code, to make a conforming change. SECTION 4.08. Amends Sections 404.024(a), (b), (d), and (f)-(i), Government Code, to delete a provision requiring the treasurer to recommend to the board a maximum limit for state funds deposited by the treasurer at approved state depositories. Deletes a provision requiring the treasurer to provide periodic investment reports to the board. Makes conforming changes. SECTION 4.09. Amends Sections 404.0245(b)-(d), Government Code, to make conforming changes. SECTION 4.10. Amends Section 404.026, Government Code, to make conforming changes. SECTION 4.11. Amends Section 404.032, Government Code, to make conforming changes. SECTION 4.12. Amends Section 404.033, Government Code, to make conforming changes. SECTION 4.13. Amends Sections 481.193(f)-(i), Government Code, to make conforming changes. SECTION 4.14. Amends Section 845.103(b), Government Code, to provide that in handling the funds of the retirement system, the board of trustees of the public retirement system has all powers and duties granted to the comptroller that formerly were granted to the State Depository Board. SECTION 4.15. Amends Section 855.103(b), Government Code, to make a conforming change. SECTION 4.16. Amends Section 2257.025(b), Government Code, to make conforming changes. SECTION 4.17. Amends Section 2257.041(d), Government Code, to make conforming changes. SECTION 4.18. Amends Sections 2257.046(b) and (c), Government Code, to make conforming changes. SECTION 4.19. Amends Sections 2257.061, 2257.062, 2257.063, and 2257.064, Government Code, to make conforming changes. SECTION 4.20. Amends Section 154.051, Tax Code, to make conforming changes. SECTION 4.21. Amends Section 20.002(2), Water Code, to redefine "authorized investments." SECTION 4.22. Repealers: Sections 404.011, 404.012, 404.001(1), 404.031(k), and 2257.002(2), Government Code (Board Membership, Application of Sunset, Open Meetings, and Administrative Procedure Laws, Definition of "board," Definition of "board," and Egg Marketing Advisory Board). ARTICLE 5. ABOLITION OF EGG MARKETING ADVISORY BOARD SECTION 5.01. Abolishes the Egg Marketing Advisory Board. SECTION 5.02. Repealer: Section 132.007, Agriculture Code (Egg Marketing Advisory Board). ARTICLE 6. ABOLITION OF ELECTRONIC DATA BASE ADVISORY COMMITTEE SECTION 6.01. Abolishes the electronic data base advisory committee. SECTION 6.02. Amends Section 481.060, Government Code, to delete existing text regarding the electronic data base advisory committee. ARTICLE 7. ABOLITION OF ENERGY ADVISORY COMMITTEE SECTION 7.01. Abolishes the energy advisory committee. SECTION 7.02. Repealer: Section 761.006, Government Code (Energy Advisory Committee). ARTICLE 8. ABOLITION OF RIO GRANDE VALLEY MUNICIPAL WATER AUTHORITY SECTION 8.01. Abolishes the Rio Grande Valley Municipal Water Authority. SECTION 8.02. Repealer: Article 8280-455, V.T.C.S. ARTICLE 9. ABOLITION OF RIO GRANDE VALLEY POLLUTION CONTROL AUTHORITY SECTION 9.01. Abolishes the Rio Grande Valley Pollution Control Authority. SECTION 9.02. Repealer: Article 8280-389, V.T.C.S. ARTICLE 10. TRANSITION; EFFECTIVE DATE; EMERGENCY SECTION 10.01. Sets forth regulations regarding the transition of property, records, and other assets of certain entities the General Services Commission. SECTION 10.02. Effective date: September 1, 1997. SECTION 10.03. Emergency clause.
