ZEM H.B. 2425 75(R)BILL ANALYSIS CIVIL PRACTICES H.B. 2425 By: Junell 4-24-97 Committee Report (Unamended) BACKGROUND Section 131.001(3), Civil Practices and Remedies Code, defines "regional collegiate athletic association" as "a regional collegiate athletic association with the majority of its member institutions in Texas." With the demise of the Southwest Athletic Conference, the definition no longer reflects current alignment of Texas schools in athletic conferences. Therefore, an inaccuracy exists in our statutes. Without correction, these conferences are not provided a cause of action under Chapter 131, Texas Civil Practice and Remedies Code. PURPOSE The bill changes the definition of "Regional Collegiate Athletic Association" to reflect the realignment due to conference changes. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 131.001(3), Civil Practices and Remedies Code, to change the definition of "Regional Collegiate Athletic Association" by substituting "one or more" of its members, for "the majority" of its members. SECTION 2. Applies prospectively. Savings clause. SECTION 3. Emergency clause. Effective date: upon passage.
