NDT H.B. 2459 75(R)BILL ANALYSIS LICENSING & ADMINISTRATIVE PROCEDURES H.B. 2459 By: Goolsby 4-28-97 Committee Report (Unamended) BACKGROUND Currently, certain persons are prohibited from purchasing a lottery ticket and from claiming, collecting, or receiving a lottery prize. These persons include employees of the lottery and employees of organizations that have contracts with the lottery. However, employees of contractors that are not directly involved in the operation of the lottery should be allowed to participate in the Texas Lottery. PURPOSE H.B. 2459 would restrict certain individuals from participating in the Texas Lottery and from claiming, collecting, or receiving a lottery prize. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Section 467.034, Government, Code, is amended. Sec. 467.034. EMPLOYEES. The executive director must employ personnel to administer the laws under the commission's jurisdiction. All commission employees serve at the will of the executive director. The executive director may not employ a person who does not met the requirements of Section 466.155. SECTION 2. Section 466.254, Government Code, is amended. Sec. 466.254. PURCHASE OF TICKET BY OR PAYMENT OR PRIZE TO CERTAIN PERSONS. A person may not purchase a ticket or claim, collect, or receive a lottery prize or share in a lottery prize if the person meets one of the following: (1) the person is a member, officer, or employee of a person that has a contract with the commission to sell or lease goods or services in the operation of the Texas Lottery, and is directly involved in the selling or leasing of goods or services pertaining to the contract for the commission; (2) the person is a member, officer, or employee of a lottery operator; (3) the person is an officer or employee of the commission; or (4) the person is a spouse, child, brother, sister, or parent living with the person described in the last three criteria. SECTION 3. This Act takes effect September 1, 1997. SECTION 4. Emergency clause.
