SCT H.B. 2512 75(R)BILL ANALYSIS STATE FEDERAL & INTERNATIONAL RELATIONS H.B. 2512 By: Hunter 4-7-97 Committee Report (Unamended) BACKGROUND: It is very common for academic and public libraries to have support groups. Usually called "Friends of the Library," these organizations exist to support to the programs and services of the library, and to raise funds to enhance these programs and services and increase their effectiveness. While no special authority is required for an independent group to form in support of the Library and Archives Commission, it is extremely desirable that the Commission participate in the formation and governance of any such organization created to support its programs and services. Such participation by the Commission does require statutory authorization. PURPOSE This legislation works to allow the Texas State Library and Archives Commission the ability to accept and use funds and services provided by non-profit or volunteer organizations. RULEMAKING AUTHORITY: This bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION-BY-SECTION ANALYSIS: SECTION 1. Amends Section 441.006(b), Government Code. Subsection(2) is changed, adding "services" to the types of donations that the commission can receive. Subsection(5) is added, to allow the commission to establish a nonprofit organization to raise funds or provide services for the commission. SECTION 2. Sets the date for which this this Act takes effect. Effective date: September 1, 1997. SECTION 3. Emergency clause.
