In 1993, South Texas Community College was created under special
legislation, codified as Section 130.0311, Education Code.  Because South
Texas Community College was converted from a branch campus of Texas State
Technical College, the transition from a state entity to a local entity
was accomplished without significant statutory coverage.  This bill
establishes the validation process necessary to assist the South Texas
Community College transition from a state entity to a local entity. 

PURPOSE

As proposed, H.B. 2528 establishes the validation process necessary to
assist the South Texas Community College transition from a state entity to
a local entity. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 130C, Education Code, by adding Section
130.0312, as follows: 

Sec.  130.0312.  VALIDATION OF CERTAIN ACTS AND PROCEEDINGS.  Sets forth
provisions for the validation of certain acts and proceedings of South
Texas Community College including confirmation proceedings and all
governmental acts and proceedings of the board of trustees of South Texas
Community College.  Provides that this section does not apply to certain
matters on the effective date of this section.   

SECTION 2. Emergency clause.
  Effective date:  upon passage.
