CN C.S.H.B. 2607 75(R)BILL ANALYSIS JUVENILE JUSTICE & FAMILY ISSUES H.B. 2607 5-9-97 Committee Report (Substituted) BACKGROUND The Texas Juvenile Probation Commission has promulgated rule 341.4(d) which requires county juvenile probation employees to be paid on the same pay scale as state adult probation employees. Neither the State of Texas nor the Texas Juvenile Probation Commission has provided funds to pay for the increased salaries. This places an unfair burden on the county to locate funds to satisfy the increase. PURPOSE HB 2607 would place the authority to determine the rate of the increase for county employees of the Red River County Juvenile Probation Department with the commissioners court. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Sec. 152.2001, Human Resources Code (HRC), (a) is amended by adding the following; The county judge serves as the chairman and chief administrative officer of the juvenile board. (b) Annual compensation of $1,200 for the added duties payable in equal monthly installments out of the general funds of the county. (c)The commissioner's court may reimburse the juvenile court judge in the county for actual and necessary expenses incurred in attending seminars and other educational or instructional meetings relating to juvenile problems. The annual reimbursement is not to exceed $600. (d)The commissioner's court shall set the annual rate of the increase in salaries for juvenile probation employees and juvenile judges at the rate of the increase given to other Red River County employees or to state employees. If the rates are different, the commissioner's court may choose one of the rates or choose a rate that is between the two rates. The following factors are taken into consideration: the source of the funds, the duties and workload of the employees, and the effect on other county employees. The commissioners court shall comply TJPC rules, unless granted a waiver, specifies penalties that may result from noncompliance with TJPC rules. (e) Sections 152.002-.007 and 152.008(a) do not apply to the juvenile board of Red River County. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency Clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The subsitutes adds to HRC Sec. 152.2001(d) that the commissioners court shall comply TJPC rules, unless granted a waiver, and specifies penalties that may result from noncompliance.
