ZEM H.B. 2650 75(R)BILL ANALYSIS CIVIL PRACTICES H.B. 2650 By: Hamric 4-10-97 Committee Report (Unamended) BACKGROUND Section 16.061 of the Civil Practices and Remedies Code provides that the State of Texas, as well as certain political subdivisions of the State are not barred from a right of action. A "Hospital District" is not one of the political subdivisions listed in Section 16.061. PURPOSE This bill would add "hospital districts" to the list of political subdivisions that are not barred from a right of action, thus giving hospital districts the ability to recover for treatment rendered but not paid for. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 16.061, Civil Practice and Remedies Code, as follows: (a) Adds hospital districts to those political subdivisions that are not barred from a right of action. (b) Defines "hospital district." Makes conforming changes. SECTION 2. Effective date: September 1, 1997. Applies prospectively; savings clause. SECTION 3. Emergency clause.
