GEC H.B. 2683 75(R)BILL ANALYSIS BUSINESS & INDUSTRY H.B. 2683 By: Dukes 4-9-97 Committee Report (Unamended) BACKGROUND Travis County began eight misdemeanor investigations based on an interpretation that it is a violation of the statutes to sell lots using a subdivision description. This bill clarifies the existing language to allow use of a pending subdivision description if the buyer is not given use or occupancy of the land. PURPOSE The bill allows the use of a subdivision description when used in a contingency contract. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1 allows a property owner to refer to the name of a subdivision in a sales contract if the contract is contingent on approval and recording of the final plat and the buyer is not given use or occupancy of the land prior to recording of the final plat. SECTION 2 states that the changes apply to contracts entered into on or after the effective date of the act. SECTION 3 states that the effective date is September 1, 1997. SECTION 4 contains an emergency clause.
