SLC H.B. 2738 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 2738 By: Uher 4-17-97 Committee Report (Unamended) BACKGROUND In mutually agreeable transactions, the Texas Board of Criminal Justice and third parties should be able to "trade" pieces of real property of equivalent value. For example, if the Board held property ideal for farming and an adjacent farmer held property ideal for building a prison, and the two were of equivalent value, the parties should have the ability to exchange the two pieces of land. PURPOSE HB 2738 would grant Texas Board of Criminal Justice the ability to exchange land with third parties. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter A, Chapter 496, Government Code, by adding Sec. 496.0032 as follows: Sec. 496.0032. EXCHANGE OF REAL PROPERTY. (a) The Texas Board of Criminal Justice may convey real property to a third party, if the third party conveys real property of an equivalent value to the Board. The General Land Office shall negotiate and close all such transactions on behalf of the Board. SECTION 2. Emergency Clause.
