SRC-SLL H.B. 2768 75(R) BILL ANALYSIS Senate Research Center H.B. 2768 By: Goolsby (Carona) State Affairs 5-14-97 Engrossed DIGEST The Texas Open Records Act assures public access to all information in the possession of governmental bodies with certain enumerated exceptions. Informal letter rulings from the attorney general's Open Records Division suggest that the Open Records Act does not apply to the Texas Lottery Commission (commission). This bill will provide regulations regarding records of the commission that are open for public inspection. PURPOSE As proposed, H.B. 2768 provides regulations regarding records of the Texas Lottery Commission that are open for public inspection. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.022, Government Code, to provide that all Texas Lottery Commission (commission) records are subject to public inspection in accordance with Chapter 552 except as otherwise provided by law. Makes a conforming change. SECTION 2. Amends Section 467.104(a), Government Code, to delete existing text regarding inspection of confidential records during regular office hours. Makes conforming changes. SECTION 3. Amends Section 28, Article 179d, V.T.C.S., to make conforming changes. SECTION 4. Effective date: September 1, 1997. SECTION 5. Emergency clause.
